Protection of personal data
In accordance with applicable regulations, DAF Darmon Avocats Famille processes personal data. The Publisher informs users that their personal data is processed for use by staff authorised by DAF Darmon Avocats Famille, as well as by the Publisher and its subcontractors.
Personal data collected through the Site, in particular through its forms (name, contact details, message), is processed by Maître Jérémie Darmon, as data controller, in order to answer users' enquiries, arrange appointments and, where applicable, handle their case. This processing is based on steps taken at the user's request prior to entering into a contract, on the performance of the fee agreement entered into with the user, and on the lawyer's legal and professional obligations.
Under the conditions laid down by the GDPR, users have a right of access, rectification, erasure and restriction of processing of their data, as well as a right to object (processing based on legitimate interests or direct marketing) and a right to data portability (data processed by automated means on the basis of their consent or of a contract). Where processing is based on their consent, users may withdraw it at any time. They may also lodge a complaint with the French data protection authority (Commission nationale de l'informatique et des libertés – CNIL, 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, www.cnil.fr).
Users may also give instructions to the Publisher regarding the fate of their data after their death.
The Publisher retains personal data for up to 3 years after the last contact for enquiries that do not proceed and, for client files, for the duration of the matter, then 5 years after the end of the engagement (Article 2225 of the French Civil Code), without prejudice to longer periods required by accounting and tax obligations.

The Publisher will respond to user requests as promptly as possible and at the latest within one month of receipt. This period may be extended by two further months, taking into account the complexity or number of requests; the user is then informed of the extension, and of the reasons for it, within one month of receipt of the request.
Intellectual property
The Publisher holds the intellectual property rights to the Site as a whole, as well as to each of its individual components (including, without limitation: its graphic design, its site structure, its navigation interfaces, its databases, its newsletters, its programs and specific developments, its content including data, texts, articles, still or animated images, files, and so on).
Subject to the exceptions provided by law, in particular short quotations stating the author and source (Article L.122-5 of the French Intellectual Property Code), any full or partial reproduction of the site or of any of its components without the Publisher's express authorisation is prohibited and would constitute infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.
The databases on the site are protected under Articles L.341-1 et seq. of the French Intellectual Property Code, and any qualitatively or quantitatively substantial extraction or reuse of the content of these databases is punishable by law.
The trademarks and logos appearing on the site belong to the Publisher or to third parties. Any reproduction, imitation or use, in whole or in part, of these distinctive signs without express authorisation, in breach of the prohibitions set out in Articles L.713-2 et seq. of the French Intellectual Property Code, engages the liability of the person responsible.

Consumer clients are informed that, in the event of a dispute relating to the agreement entered into with the firm, they may make use of consumer mediation, free of charge, or any other alternative dispute-resolution method.

Consumer clients are informed that the mediator cannot consider disputes where the claim is manifestly unfounded or abusive, or has already been examined or is being examined by another mediator or by a court.
The same applies where the consumer client submits their request to the mediator more than one year after their written complaint to the firm, where the dispute falls outside the mediator's jurisdiction, or where the consumer cannot show they first attempted to resolve the dispute directly with the firm through a written complaint.
